Pre-Arrest and Pre-charging Representation

If you have been recently arrested, or you have been made aware by law enforcement that you are the subject of an investigation, it is critical that you call our law office immediately! Often a person will know of a potential criminal charge before he or she is actually arrested and charged with a crime. In many cases, law enforcement agents will contact a suspect as part of the criminal investigation. In those circumstances, the Law Offices of Brian E. Gonzalez, P.A. has criminal lawyers to assist our clients by speaking with the government investigators, meeting with prosecutors, and conducting our own thorough investigation in an effort to prevent charges from being filed. In many situations, the Law Offices of Brian E. Gonzalez, P.A. can prevent a client from being charged or can convince the government to file less severe charges. In cases where the charge is pending but the client has not been arrested, we can arrange for the quick and convenient surrender of the client and secure an "ROR" (release on recognizance) or a reasonable bond in advance.

Criminal charges can be dismissed or reduced after a formal filing, however it is always beneficial to address the State Attorney's Office before formal charges are filed. You should also be aware that your arrest does not mean that formal charges will necessarily be filed against you. The same holds true if you are being investigated by law enforcement. Any time there is a question as to whether formal charges should be filed, the State Attorney's Office will review the evidence and ultimately make filing decision. This is also important because the criminal suspect or defendant is not in a position to speak to law enforcement or the prosecutor's office. Any suspect or defendant that agrees to speak to a law enforcement officer or the State Attorney's Office without counsel obviously means a tremendous risk of damaging their case severely. That is why it is extremely important to call our office immediately if you have been arrested or you have become aware that you are the suspect of any criminal investigation.
